Upon arrival, officers proceeded to the rear of an adjacent property marked with a sign stating "Private Property, No Trespassing” at 1220 Blue Hill Avenue where the officers observed two males sitting in a red car with both doors open.
Officers were advised that a possible suspect was near a red vehicle in the rear of 37 Leston Street. INCIDENT #2: At about 9:10 PM on Wednesday, May 2, 2018, officers from District B-3 (Mattapan) responded to a radio call for shots fired in the area of 37 Leston Street, Mattapan. Philyaw was placed under arrest and charged with Unlawful Possession of a Firearm, Unlawful Possession of Ammunition, and Unlawfully Carrying a Loaded Firearm.
Officers recovered a loaded black Smith and Wesson. Officers conducted a pat frisk of the suspect and immediately felt a hard object consistent with a firearm in the right pocket of Philyaw’s shorts. Due to the officers’ observations, training and experience, they feared Philyaw may be armed, prompting officers to request Philyaw to exit the vehicle. Officers gave Philyaw several verbal commands to remain still, but Philyaw did not comply. Using only his left hand, Philyaw continued to reach across his body toward the center console of the vehicle. As Philyaw produced his license, the officers observed that he was becoming increasingly nervous and refused to keep his hands in plain sight. Officers made a stop of the vehicle and requested the operator of the motor vehicle, later identified as 25-year-old Christopher Philyaw of Dorchester, to produce his driver’s license.

A query of the license plate number revealed that the motor vehicle’s registration had expired.
